1. Acceptance of Terms

By using Tracy Porta Potty's services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Provided

Tracy Porta Potty provides portable toilet rental services including:

• Standard portable toilets
• Deluxe portable toilets
• ADA accessible units
• Handwashing stations
• Luxury restroom trailers
• Delivery, setup, and pickup services
• Regular maintenance and cleaning

3. Rental Terms

3.1 Rental Period

Rental periods are typically weekly, but daily and monthly rates are available. The rental period begins on the delivery date and ends on the pickup date.

3.2 Delivery and Pickup

We will deliver units to the specified location during normal business hours. Customer must provide clear access to the delivery location. Pickup will be scheduled at the end of the rental period.

3.3 Placement Requirements

• Units must be placed on level, stable ground
• Adequate access for delivery and pickup vehicles
• Customer responsible for obtaining necessary permits
• Units cannot be moved once placed without authorization

4. Customer Responsibilities

• Provide accurate delivery information and site access
• Ensure units are used only for their intended purpose
• Prevent damage, vandalism, or misuse of equipment
• Report any issues or needed repairs immediately
• Ensure units are accessible for scheduled service
• Comply with all local health and safety regulations

5. Payment Terms

5.1 Pricing

Prices are subject to change without notice. Current pricing will be provided with each quote.

5.2 Payment

Payment is due upon delivery unless other arrangements have been made. We accept cash, check, and major credit cards.

5.3 Late Fees

Late fees may apply to overdue accounts. Extended rental periods beyond the agreed term will incur additional charges.

6. Damage and Loss

Customer is responsible for any damage to or loss of rented equipment beyond normal wear and tear. Charges for damage or loss will be based on repair or replacement costs.

Examples of chargeable damage include but are not limited to: vandalism, fire damage, chemical damage, theft, or damage due to improper use.

7. Cancellation Policy

Cancellations must be made at least 24 hours before scheduled delivery to avoid charges. Cancellations made less than 24 hours before delivery may incur a cancellation fee.

8. Limitation of Liability

Tracy Porta Potty's liability is limited to the rental fee paid. We are not liable for indirect, incidental, or consequential damages. Customer assumes responsibility for proper use and safety around rented equipment.

9. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our control, including but not limited to weather, natural disasters, or government regulations.

10. Governing Law

These terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of San Joaquin County, California.
